Privacy Policy

This Privacy Policy explains how Emarzen collects, uses, shares, and protects personal data when you use our websites, dashboards, and services (the “Services”). Where we decide why and how to process personal data, we act as a controller. When we process certain data on behalf of Advertisers (e.g., conversion data tied to their Offers), we act as a processor/service provider under applicable laws.

Scope & Who We Are

Emarzen is the controller for personal data collected via our sites and Services unless stated otherwise in an offer-specific notice or data processing addendum (DPA). Contact: privacy@emarzen.com | [postal address].

What We Collect

  • Account & contact data (name, email, role, company, address, payment details for payouts/billing).
  • Usage & device data (IP address, device/user agent, pages viewed, timestamps, referral URLs, click IDs, network IDs).
  • Event/transaction data related to Offers (clicks, conversions, order totals, currency, discount code used, anonymized identifiers).
  • Compliance artifacts (KYC/KYB info, tax forms, domain ownership, consent logs).
  • Support content (messages, ticket notes, call/chat recordings where permitted).

Sources

  • Directly from you (registration, support).
  • Automatically via cookies/SDKs/server logs when you or your users interact with pages and links.
  • From integrated advertisers, networks, analytics, fraud-prevention, and payment partners.

Purposes & Legal Bases

We process personal data to:

  • Provide and operate the Services (set up accounts, measure clicks/conversions, manage offers, process payouts) — Contract.
  • Secure and maintain (fraud detection, abuse prevention, diagnostics, availability) — Legitimate interests / Legal obligation.
  • Comply with law (tax, accounting, sanctions/KYC) — Legal obligation.
  • Communicate about changes, features, onboarding, compliance — Contract / Legitimate interests.
  • Improve the Services (analytics, QA, feature development) — Legitimate interests.
  • Marketing with your consent and opt-out choices — Consent / Legitimate interests.

Cookies & Similar Technologies

We use cookies, pixels, and server-to-server signals to recognize devices, measure clicks and conversions, and attribute commissions. You can manage preferences via our Cookie Settings and your browser settings. Some features require essential cookies.

Disclosures of Personal Data

We share limited personal data with:

  • Advertisers and networks to validate conversions and pay commissions (usually aggregated or hashed where possible).
  • Vendors that host, process payments, provide analytics, fraud detection, communications, and support.
  • Corporate transactions (merger/acquisition) where data may transfer with safeguards.
  • Legal/regulatory recipients where required.

We do not sell personal data in the common sense of the term. Where “sale” or “sharing” is broadly defined (e.g., under CPRA), we will offer opt-out mechanisms where applicable.

International Transfers

If we transfer data internationally, we use appropriate safeguards (e.g., Standard Contractual Clauses and supplementary measures). Details are available in our DPA.

Retention

We keep data only as long as needed for the purposes described, to meet legal/accounting obligations, and to resolve disputes. Operational click/conversion logs are typically kept for attribution windows and fraud analysis before aggregation/anonymization.

Your Rights

Depending on your location, you may have rights to access, correct, delete, restrict/opt-out, port, or object to processing. California residents have additional rights (e.g., “Do Not Sell or Share,” “Limit Use of Sensitive PI”) and can use opt-out preference signals where required. We will not discriminate for exercising these rights.

Children

The Services are not intended for children under 13 (or the age defined by local law). We do not knowingly collect their data. If we become aware of such data, we will delete it.

Security

We apply administrative, technical, and physical controls, including encryption in transit, access controls, and monitoring. No method is 100% secure, but we continuously improve safeguards and maintain incident response procedures.

Marketing, Disclosures, Opt-Out

Publishers and Advertisers must comply with applicable marketing and endorsement laws; Publishers must provide clear affiliate disclosures where required (FTC, etc.). You can opt out of marketing emails via unsubscribe links; essential service communications will still be sent.

Service Providers / Processors

When acting as a processor/service provider on behalf of an Advertiser, we process personal data only on documented instructions, ensure confidentiality, implement security measures, assist with data subject requests, and delete/return data at the end of services, consistent with applicable law and our DPA.

Do Not Track

We currently respond to opt-out preference signals and honor browser controls where required by law; otherwise, DNT signals may not be uniformly recognized.

Changes to This Policy

We may update this Policy. Material changes will be posted in the dashboard and/or emailed with the effective date; continued use indicates acceptance.
